DAEMON Tools Lite End User License Agreement

IMPORTANT - READ CAREFULLY: This DAEMON Tools Lite End-User License Agreement ("EULA") is agreement between you (either an individual or a single entity) and DT Soft Ltd for the DAEMON Tools Lite software product identified above, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, download or use the SOFTWARE PRODUCT.
This SOFTWARE PRODUCT is NOT freeware. You are entitled to use SOFTWARE for free ONLY for your personal and non-commercial purposes.
If you DO NOT use this program strictly for your personal and non-commercial purposes only (for example, if you are using it in some public commercial or non-profit organization e.g. in a company, university, library, other public institutions, Internet cafe etc. or you are using it privately but for commercial purposes) then you HAVE TO register a license in order to use SOFTWARE PRODUCT. Please visit our site at http://www.daemon-tools.cc/ where select "Products" and then "DAEMON Tools Lite" for details. You are only allowed to use this program if your local law allows that and you are a legal owner of the original CD or DVD and you want to create or use a backup of your original CD or DVD. Feel free to use this package in other FREE products, as long as you leave this package unmodified and include credits to the authors. Commercial Programs that 'need' or 'base on' our program (e.g. GUI etc.) require the written permission of the author. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. DT Soft Ltd or its suppliers own the title, copyright and other intellectual property rights contained in the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is licensed, not sold.

1. GRANT OF LICENSE.
   This EULA grants the following rights provided to you to comply with all terms and conditions contained in this EULA:
   • Installation and Use. DT Soft Ltd grants to you a non-exclusive and limited license to install and use a reasonable number of copies of the SOFTWARE PRODUCT in depend of your license.
     Free license: you may install and use one copy of the SOFTWARE PRODUCT on a single computer including a workstation, terminal or other digital electronic device ("COMPUTER").
     Paid license: you may install and use additional copies of the SOFTWARE PRODUCT up to the quantity limit according to selected type of multi-user license.
     You may move the SOFTWARE PRODUCT to a different COMPUTER. After that you must completely remove the SOFTWARE PRODUCT from the previous COMPUTER.
   • Reservation of Rights. DT Soft Ltd reserves all rights not expressly granted to you in this EULA.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
   • Limitations on Reverse Engineering, Decompilation and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that applicable law notwithstanding this limitation expressly permits such activity.
   • Separation of Components. The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one computer.
   • Support Services. DT Soft Ltd may provide you with support services related to the SOFTWARE PRODUCT ("Support Services"). Use of Support Services is governed by the DT Soft Ltd policies and programs described in "online" documentation, and/or in other materials provided by DT Soft Ltd. Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information, you provide to DT Soft Ltd as a part of the Support Services, DT Soft Ltd may use such information for its business purposes, including product support and development. DT Soft Ltd will not utilize such technical information in a way that personally identifies you.
     Paid license users are entitled to unlimited technical support. Free license users may receive technical support, but it is not obligatory. Technical support is provided via e-mail ONLY.
     Support services will NOT be provided to users who would use very rude or obscene language in their support requests.
   • Privacy protection. The SOFTWARE PRODUCT does not gather any data from the computer except the data related to the SOFTWARE PRODUCT license.
   • Applicable law. This EULA is governed by law of Belize.
   • No Rental: You may not rent, lease, or lend the SOFTWARE PRODUCT.
   • Termination. Without prejudice to any other rights, DT Soft Ltd may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
3. DISCLAIMER OF WARRANTIES.
   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DT Soft Ltd AND ITS SUPPLIERS PROVIDE THE SOFTWARE PRODUCT AND ANY (IF ANY) SUPPORT SERVICES RELATED TO THE SOFTWARE PRODUCT ("SUPPORT SERVICES") AS IS AND WITH ALL FAULTS, AND HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY (IF ANY) IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF LACK OF VIRUSES, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, AND OF LACK OF NEGLIGENCE OR LACK OF WORKMANLIKE EFFORT, ALL WITH REGARD TO THE SOFTWARE PRODUCT, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. IN ADDITION, THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, AND CORRESPONDENCE TO DESCRIPTION OR NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE PRODUCT. THE ENTIRE RISK AS TO THE QUALITY OF OR ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE PRODUCT AND SUPPORT SERVICES, IF ANY, REMAINS WITH YOU.
4. EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES.
   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DT Soft Ltd OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS EULA, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF DT Soft Ltd OR ANY SUPPLIER, AND EVEN IF DT Soft Ltd OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
5. LIMITATION OF LIABILITY AND REMEDIES.
   NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL DIRECT OR GENERAL DAMAGES), in no event will DT Soft Ltd AND ANY OF ITS SUPPLIERS UNDER ANY PROVISION be liable for any damages or losses arising from the use of SOFTWARE PRODUCT or inability to use the SOFTWARE PRODUCT, including, without limitation, damages to users’ systems and/or software and/or data, computer failure or malfunction, computer virus transmission, performance delays or communication failures or security breaches. This provision shall survive the expiration or termination of this Agreement.
6. HIGH RISK ACTIVITIES.
   The SOFTWARE PRODUCT is not fault-tolerant and is not designed, manufactured or intended for use in environments in which its failure could lead directly to death, personal injury, or severe physical or environmental damage, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems ("High Risk Activities"). ACCORDINGLY, DT Soft Ltd AND ITS LICENSORS AND OTHER SUPPLIERS SPECIFICALLY DISCLAIM ANY EXPRESS OR IMPLIED WARRANTY OF FITNESS FOR HIGH RISK ACTIVITIES. YOU AGREE THAT DT Soft Ltd WILL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES ARISING FROM THE USE OF THE SOFTWARE PRODUCT IN SUCH APPLICATIONS.
7. U.S. GOVERNMENT USERS.
   If you are a U.S. Government user, then the Software Application is provided with "RESTRICTED RIGHTS" as set forth in subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights clause at FAR 52 227-19 or subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, as applicable.
8. ENTIRE AGREEMENT.
   This EULA (including any addendum or amendment which is supplied with the SOFTWARE PRODUCT) constitutes the entire agreement between you and DT Soft Ltd relating to the SOFTWARE PRODUCT and the support services (if any) and they supersede all prior or contemporaneous oral or written communications, proposals and representations with respect to the SOFTWARE PRODUCT or any other subject matter covered by this EULA. To extent of terms of any DT Soft Ltd policies or programs for support services conflict with the terms of this EULA, the terms of this EULA shall control.

DT Soft Ltd is licensed to use within its software "SCSI Pass Through Direct (SPTD) layer".
SPTD layer software ("SPTD Software") End User License Agreement
THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) AND Duplex Secure Ltd.
THIS SPTD Software END USER LICENSE AGREEMENT (THE "AGREEMENT") GOVERNS USE OF THE SPTD Software AND ANY RELATED SOFTWARE SERVICES PROVIDED BY Duplex Secure Ltd OR ITS PARTNERS IN CONNECTION WITH THE SPTD Software. BY CLICKING "I AGREE," OR BY DOWNLOADING, INSTALLING OR USING THE SPTD Software, YOU AGREE TO THE TERMS OF THIS AGREEMENT, AND YOU CONSENT TO JURISDICTION OF THE EUROPEAN UNION FOR ANY DISPUTE. YOU ACKNOWLEDGE THAT Duplex Secure Ltd OFFERS THE SPTD Software WITHOUT WARRANTIES AND THAT YOUR REMEDIES ARE LIMITED. IF YOU DO NOT AGREE TO THIS AGREEMENT, CLICK "EXIT" AND DO NOT INSTALL OR USE THE SPTD Software.

1. GRANT OF LICENSE.
   Duplex Secure Ltd grants you a personal, limited, non-exclusive, non-sublicensable, non-transferable license to use the SPTD Software for personal and internal business purposes any provided copy must contain all of the original proprietary notices.
   This license does not entitle you to receive from SPTD Software hard-copy documentation, support, telephone assistance, enhancements or updates to the SPTD Software.
2. RESTRICTIONS.
   You may not: (i) modify or create any derivative works of the SPTD Software or documentation, including customization, translation or localization (aside from any rights you may have to modify those portions of the source code released under a separate source code license); (ii) decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code of the SPTD Software, or in any way ascertain, decipher, or obtain the communications protocols for accessing the SPTD Software, or the underlying ideas or algorithms of the SPTD Software; (iii) use kernel mode debuggers (SoftICE, WinDbg etc.) because SPTD Software is not compatible with such debuggers; (iv) use the SPTD Software to reproduce, display, perform, or distribute audio and/or video content in any manner that violates any U.S. or foreign laws or regulations or any third party's rights, including copyright, privacy or publicity rights, or other intellectual property rights; (v) redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer rights to the SPTD Software ; (vi) remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the SPTD Software; (vii) block, disable, or otherwise effect any windows, tabs, links to other sites and services, or other features that constitute an integral part of the SPTD Software; (viii) use the SPTD Software in any way that violates this Agreement or any law; or (ix) authorize or assist any third party to do any of the things described in this paragraph.
3. TERMINATION.
   If you violate the terms of this Agreement, this Agreement and your right to use the SPTD Software shall be terminated immediately and without notice. In the event of any termination of this Agreement or your rights hereunder, all provisions of this Agreement except the "GRANT OF LICENSE" section shall survive such termination and you agree to continue to be bound by those terms. Upon termination, you must destroy all copies of the SPTD Software.
4. PROPRIETARY RIGHTS.
   Duplex Secure Ltd and/or its licensors and other suppliers retain all title, ownership, and intellectual property rights in the SPTD Software. The SPTD Software is protected by copyright and other intellectual property laws and by international treaties.
5. INJUNCTIVE RELIEF.
   You acknowledge and agree that, notwithstanding any other provisions of this Agreement, your breach or threatened breach of this Agreement shall cause Duplex Secure Ltd irreparable damage for which recovery of money damages would be inadequate and that Duplex Secure Ltd, therefore, may obtain timely injunctive relief to protect its rights under this Agreement in addition to any and all other remedies available at law or in equity.
6. DISCLAIMER OF WARRANTY.
   THE SPTD SOFTWARE IS PROVIDED WITH ALL FAULTS ON AN "AS IS" BASIS. DUPLEX SECURE LTD AND ITS LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES THAT THE SPTD SOFTWARE IS FREE OF DEFECTS, VIRUS FREE, AND ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, THAT THE FUNCTIONALITY OF THE SPTD SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT ERRORS IN THE SPTD SOFTWARE WILL BE CORRECTED, AND THE IMPLIED WARRANTIES THAT THE SPTD SOFTWARE IS MERCHANTABLE, OF SATISFACTORY QUALITY, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, OR NON-INFRINGING, UNLESS SUCH IMPLIED WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION. FURTHER, DUPLEX SECURE LTD AND ITS LICENSORS AND SUPPLIERS DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SPTD SOFTWARE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. IN ADDITION, THE SECURITY MECHANISMS IMPLEMENTED BY THE SPTD SOFTWARE HAS INHERENT LIMITATIONS, AND YOU MUST DETERMINE THAT THE SPTD SOFTWARE SUFFICIENTLY MEETS YOUR REQUIREMENTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY DUPLEX SECURE LTD OR A DUPLEX SECURE LTD AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW. DUPLEX SECURE LTD, ITS LICENSORS, AND OTHER SUPPLIERS HAVE NO LIABILITY WITH RESPECT TO YOUR USE OF THE SPTD SOFTWARE. YOU BEAR THE ENTIRE RISK AS TO ITS QUALITY AND PERFORMANCE AND ASSUME THE ENTIRE COST OF ANY SERVICE AND REPAIR. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS AGREEMENT. NO USE OF THE SPTD SOFTWARE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
7. LIMITATION OF LIABILITY.
   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DUPLEX SECURE LTD OR ITS PARENT, AFFILIATES, DIRECTORS, EMPLOYEES, DISTRIBUTORS, LICENSORS, SUPPLIERS, AGENTS OR RESELLERS (COLLECTIVELY, THE "DUPLEX SECURE LTD GROUP") BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE SPTD SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, LOST PROFITS, LOSS OF DATA, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF, AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.
8. ROOT CERTIFICATION ISTALLATION DISCLOSURE.
   SPTD Software adds a root Certificate during installation of SPTD Software. The Root Certificate name is "Generic Root Trust CA" (Thumbprint: ce 1a 35 53 ba 61 55 da 51 60 09 7b 4b 1e a1 ff 4c ba 71 95). Root certificate is being installed by SPTD software setup, which is signed by VeriSign Class 3 certificate, as part of Duplex Secure Ltd own Public Key Infrastructure (PKI) used to verify integrity of files being installed and integrity of dependent software.
9. HIGH RISK ACTIVITIES.
   The SPTD Software is not fault-tolerant and is not designed, manufactured or intended for use in environments in which its failure could lead directly to death, personal injury, or severe physical or environmental damage, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems ("High Risk Activities"). YOU AGREE THAT THE DUPLEX SECURE LTD WILL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES ARISING FROM THE USE OF THE SPTD SOFTWARE IN SUCH APPLICATIONS.
10. U.S. GOVERNMENT USERS.

By downloading, installing or using this DAEMON Tools Toolbar Software (“Software”) or any portion thereof, you agree to the terms and conditions of this End User License Agreement (“Terms”).
THESE TERMS CONSTITUTE THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOU, OR THE COMPANY ON WHOSE BEHALF YOUR ARE INSTALLING THE SOFTWARE ("YOU") AND DT Soft Ltd, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION RELATING TO THE SUBJECT MATTER OF THESE TERMS.
PLEASE READ CAREFULLY AND ACCEPT THE TERMS BEFORE INSTALLING THE SOFTWARE BY CLICKING THE "YES" BUTTON (OR ANY SIMILAR BUTTON WHICH INDICATE YOUR CONSENT TO THESE TERMS), YOU AGREE TO BE BOUND BY THESE TERMS. DT Soft Ltd provides an automated, Internet-based platform that enables online Publishers (“Publisher”) to communicate with their users via community toolbars, desktop alerts and other website syndication solutions. This software was created using DT Soft Ltd platform by a DT Soft Ltd toolbar Publisher.

1. GRANT OF LICENSE.
   DT Soft Ltd hereby grants You a limited personal, non-exclusive, non-sublicensable, non-assignable, free of charge license to download, install and use the Software solely for internal, non-commercial purposes in order to enhance Your Internet surfing experience by being provided with relevant references displayed at the top of Your browser and/or desktop and/or other applicable platforms.
2. OWNERSHIP.
   All rights to and in the Software (including all documentation, translations, enhancements, improvements or other modifications made to or derived from the Software), including, but not limited to, copyrights, patents, trademarks, trade secret rights and any other applicable intellectual property right, shall belong to DT Soft Ltd and/or their respective owners.
3. RESTRICTIONS.
   You shall not modify the Software. You may only copy the Software, only if all copyright and other notices are reproduced and included on the copy.
   You may not (1) decompile, reverse engineer, disassemble or otherwise reduce the Software or any portion of the Software to a human-perceivable form, (2)modify, network, rent, lend, loan, distribute or create derivative works based upon the Software in whole or in part, and (3) commercially distribute, market, sublicense, resell or otherwise transfer the Software. You may not make any use of the Software in whole or in part, that is not expressly permitted by these Terms.
   The Software is delivered in object code only.
   Either DT Soft Ltd, or a third party that provides components contained in the Software, may modify the functionality of the Software at any time.
   You acknowledge that during installation, the Software may change the default search engine in Your browser's search box, if such a search box exists in Your browser. You in advanced and reconfigured from your toolbar options menu can approve such changes.
4. TERMINATION.
   These Terms shall continue in effect perpetually, unless terminated earlier pursuant to the provisions herein. You may terminate these Terms at any time by permanently deleting from Your systems and/or destroying all copies of Software in Your possession. DT Soft Ltd may terminate these Terms and the license granted pursuant thereto if You breach any of the Terms. Upon termination of these Terms for any reason, You shall permanently delete and/or destroy all copies of the Software. All provisions of these Terms relating to "OWNERSHIP", "LIMITATION OF LIABILITY AND WARRANTY", "PRIVACY AND LEGAL RIGHTS" and "GENERAL" shall survive the termination of these Terms.
5. LIMITATION OF LIABILITY AND WARRANTY.
   DT Soft Ltd DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATIONS OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. DT Soft Ltd AND ITS THIRD PARTY LICENSORS, IF ANY, DISCLAIM ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. NO ORAL OR WRITTEN INFORMATION OR ADVICE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY.
   IN NO EVENT WILL DT Soft Ltd OR ANY THIRD PARTY (WHICH DISTRIBUTES, PROMOTES OR PROVIDES COMPONENTS CONTAINED IN THE SOFTWARE), BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR INDIRECT DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, LOST SAVINGS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS, ARISING OUT OF USE OF OR INABILITY TO USE THE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF DT Soft Ltd HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
   THE SOFTWARE IS BEING PROVIDED TO YOU FREE OF CHARGE. ACCORDINGLY, YOU ACKNOWLEDGE AND AGREE THAT DT Soft Ltd, ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL HAVE NO LIABILITY IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SOFTWARE.
   YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH THE SOFTWARE IS TO DEINSTALL AND CEASE USE OF SUCH SOFTWARE.
   SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
6. PRIVACY AND LEGAL RIGHTS.
   Protecting Your privacy is very important for DT Soft Ltd. Our platform is constantly monitored to maintain and enforce our strict Privacy Policy and we contractually prohibit our Publishers (as such term defined below) from violating the privacy rights of others while utilizing our platform. You acknowledge that You have read and approved the toolbar privacy policy of DT Soft Ltd posted from time to time at http://www.daemon-toolbar.com/privacy.
   DT Soft Ltd respects the legal rights of others, and we ask our Publishers to do the same. We contractually prohibit our Publishers to use our platform to promote or distribute illegal materials, materials protected by intellectual property rights, or offensive materials.
   It is important to download only from Publishers You trust, whether browser add-ons, toolbars or any other software. DT Soft Ltd is not responsible for content that is uploaded to the DT Soft Ltd platform by any Publisher or by any third party.
   If You believe that Your legal rights have been infringed upon while using the Software, we encourage You to report it to us at Your earliest convenience (to report, please, visit the "Contact us" page on DAEMON Tools Toolbar website at http://www.daemon-toolbar.com/sendmsg). As soon as we receive Your notification, we will, at our discretion, examine Your complaint and take the necessary measures to resolve it.
   "Publisher" means an individual or entity that creates a toolbar using the DT Soft Ltd platform. Such Publisher makes the toolbar available for download on any domain and/or website owned and/or operated by such Publisher or by a third party licensed by Publisher. The toolbar is used by an Internet user, such as You, who downloads and installs the toolbar created by the Publisher.
7. ENTIRE AGREEMENT.
   These Terms shall be governed by and interpreted under the laws of Belize, without regard to conflicts of provisions. All actions related to these Terms and the Software shall be brought in the competent court of Belize. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. The failure of either party to enforce any rights granted hereunder or to take action against the other party in the event of any breach hereunder shall not be deemed a waiver by that party as to subsequent enforcement of rights or subsequent actions in the event of future breaches. If for any reason, a court of competent jurisdiction finds any provision of these Terms or portion thereof, to be unenforceable, that provision of these Terms shall be enforced to the maximum extent permissible to effect the intent of the parties, and the remainder of these Terms shall continue in full force and effect. DT Soft Ltd reserves the right, at its own discretion, to update or revise these Terms. Please check the Terms periodically for changes at http://www.daemon-toolbar.com/terms. Your continued use of the Software following the posting of any changes to the Terms, or notification to You about the changes, constitutes acceptance of those changes.
   YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS AND AGREE TO BE BOUND BY THE TERMS AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN. BY CLICKING ON THE AGREE BUTTON AND/OR CONTINUING TO INSTALL OR USE THE SOFTWARE, YOU EXPRESSLY CONSENT TO BE BOUND BY THESE TERMS.
